Court orders FKF to include Mombasa United as 18th club, Premier League kick-off postponed



The High Court in Kiambu has ordered the Football Kenya Federation (FKF) to include Mombasa United Football Club as the 18th club in the 2026/2027 SportPesa Premier League, forcing the postponement of the season that was set to kick off on Saturday, September 19, 2026.

In Case HCCHRPET/E107/2026, Center for Litigation Trust versus Football Kenya Federation, Justice Francis Nyungu Kyambia certified an urgent application and issued conservatory orders directing FKF to publish provisional revised fixtures featuring Mombasa United.

"That pending the inter-parties hearing, the respondent is hereby ordered to publish provisional revised fixtures to include Mombasa United Football Club as the eighteenth club and permit Mombasa United Football Club to participate in 2026/2027 SportPesa Premier League subject to other requirements of the respondent," the order reads.

The judge directed that the application be served upon FKF within three days and that the federation file and serve its response within three days of service. The matter is set for inter-partes hearing on September 29, 2026.
The order carries a penal notice warning that any disobedience or non-observance shall attract penal consequences.

Following the order, FKF announced the postponement of the league kick-off that had been scheduled for Saturday, just days after it had confirmed the new season would finally begin after weeks of uncertainty arising from disputes over promotion and relegation.

In a statement to clubs and partners, the federation said: "We regret to inform all participating clubs and partners that the league kick-off has been postponed until further notice. We will provide a comprehensive statement with regard to the details surrounding the postponement. Kindly accept our sincerest apologies for any inconvenience caused."

The Kiambu order comes barely two weeks after the High Court in Nairobi, in HCTA/E081/2026, Kariobangi Sharks Football Club versus Football Kenya Federation, preserved the status quo obtaining prior to the Sports Disputes Tribunal decision of August 10, 2026, pending directions on September 21, 2026.

The inclusion of Mombasa United means the league will provisionally have 18 teams, unless the order is varied or set aside.

Government Urged to End Abductions Across the Country

Center for Litigation Trust (CFLT) has condemned the recent abduction of Standard group Editor Alex Kiprotich. The  independent Pan-African public interest law center emphasized the need for Journalists to be protected to be able to perform their duties.  The Trust's Executive Director Mr. Julius Ogogoh further demanded the government to issue a public statement rejecting forced dissapearance and abductions.
